Apple, Samsung set to return to Federal Court in Australia

Samsung and Apple Australia are set to return to the Federal Court in Sydney on Monday to determine the next step in Apple’s patent war against the Samsung Galaxy Tab 10.1, reports “ZDNet” (http://macte.ch/k3KDM).

Justice Annabelle Bennett said in the initial hearing that unless the two parties could resolve their differences before Aug. 29, they would return to the court for a further directions hearing, the article adds. She added that the case could bring with it hefty fines for Samsung if it went Apple’s way.


Earlier this month it was announced that Apple had won an agreement from Samsung that the South Korean company won’t sell the newest version of its tablet computer in Australia until a patent lawsuit in the country is resolved.

The Samsung Galaxy Tab 10.1 infringes 10 Apple patents, including the “look and feel,” and touchscreen technology of the iPad, Steven Burley, a lawyer for Apple, told Federal Court Justice Annabelle Bennett in Sydney. Apple sought an Australian injunction and wants to stop Samsung from selling the tablet in other countries, Burley said.
