Elite Computers & Software has filed its third amended complaint against Apple. The compaint is now available for download for the first time at TellOnApple.org. “Three new causes of action have been added to our complaint,” said Thomas Armes, President of Elite. “These are very interesting times as we have come from being Apple Specialists to Legal Specialists! I spend a lot of my time working on the case and I look forward to our day in court.”

Elite Computers & Software, a Mac retailer since 1987, has closed five of its California stores, according to the Silicon Valley Business Journal. Owner Thomas Armes blames Apple for the closings, citing problems with new reseller contracts. He also said that Apple delivered new products to its own retail stores before they would ship to him. “We didn’t get as much product as the Apple Stores, and we got it later than the Apple Stores,” Armes says.

Elite Computers has filed a lawsuit against Apple, seeking more than US$5 million in compensation for what it says is breach of contract, unfair competition, false advertising and fraud. The Silicon Valley Business Journal reports that the suit was filed last month in Santa Clara County Superior Court, and cites Apple’s use of its new retail and online stores in engaging in unfair competition.
